Preliminary Site-Specific Analysis

This property has a documented history as a farm and agricultural operation predating 1986. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup — and recover costs already spent.

This Ferndale property was originally developed as a railroad switching and maintenance yard in the early to mid-1900s, with BNSF subsequently leasing the land to a succession of primarily agricultural businesses including Ferndale Grain, Inc. Cargill entered a lease on the property in 2003, with existing Ferndale Grain buildings already on site. A Phase II investigation identified diesel-range organics (DRO) in groundwater exceeding cleanup criteria at multiple monitoring wells, arsenic concentrations above Washington's Method A criterion, and cadmium contamination in soil. Cleanup is underway under the state's standard cleanup program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

Railroad and agricultural operations at this property date to the early to mid-1900s — decades before 1986, when occurrence-based Commercial General Liability policies were the industry standard and carried no effective pollution exclusion. The contamination now documented in groundwater and soil — diesel-range organics, arsenic, and cadmium — reflects the environmental legacy of nearly a century of industrial and agricultural use at the site. Historical CGL carriers who insured the railroad and agricultural operators during that pre-1986 window may bear obligations both to recover past remediation expenditures and to fund the cleanup work still ahead.

Task 1 — Research and Analysis
Restorical searches for viable historical insurance policies, researches the site history, analyzes the contamination impacts, and underwrites potential coverage — including a proprietary trigger analysis. At the end of Task 1, we provide a clear yes or no on whether a successful cost recovery is possible, along with a strategy and recommendation specific to your situation, even if you are not the policyholder.
