The tank's complete absence from federal UST registries — required under RCRA Subtitle I beginning in 1984 — indicates installation predating the registration era. Laboratory analysis of groundwater samples identified a Bunker C fuel signature consistent with older heating oil systems, and diesel-range and oil-range total petroleum hydrocarbons were confirmed above MTCA Method A Cleanup Levels in multiple wells. Cleanup is underway, with Puget Sound approximately 300 feet to the south-southeast creating potential surface water and sediment exposure pathways that have not yet been evaluated. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington.
