This property has operated as a gasoline station since at least 1976, when the commercial structure was built, with three 10,000-gallon underground storage tanks used for gasoline storage. UST removal was conducted in 2025, and groundwater sampling confirmed petroleum contamination far exceeding MTCA Method A cleanup levels — benzene at 88 µg/L against a standard of 5, gasoline at 19,000 µg/L against 800, toluene at 1,300 µg/L against 1,000, and xylenes at 4,300 µg/L against 9. The site is currently awaiting cleanup under the Standard Cleanup program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington.
