This property has a documented history as a public works and maintenance facility going back to 1954. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup.

The property was acquired by the General Services Administration for the U.S. Army between 1954 and 1956 through condemnation proceedings and purchases, and operated as Nike Ajax (S-82) Battery A, 4th Battalion, 4th Artillery Regiment on Bainbridge Island. During Department of Defense operations, underground storage tanks containing diesel fuel and heating oil were maintained on site, and carbon tetrachloride, trichloroethylene (TCE), and 1,1,1-trichloroethane (TCA) were used for cleaning and maintenance. A 1986 environmental investigation was conducted at the former Launch Area, and a Draft Final Preliminary Assessment completed in 2021 identified a potentially complete surface water exposure pathway, with wetlands and salmon-spawning streams downstream from areas of concern. The site is currently awaiting cleanup under Washington's Standard Cleanup program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

Military operations at this property began in 1954 — more than three decades before occurrence-based Commercial General Liability policies ceased reliably covering pollution claims. The contaminants now suspected in surface water — halogenated solvents, petroleum hydrocarbons, PCBs, heavy metals including arsenic, lead, and mercury — trace directly to operational activities during that pre-1986 window. The cleanup costs this site now faces could plausibly fall within the coverage obligations of historical carriers whose policies were in effect when those releases originated.
