CF Industries has operated a bulk fertilizer storage facility in Ritzville since at least September 1983, when three large aboveground storage tanks — two for ammonia and one for urea ammonium nitrate (UAN) — were installed with a combined capacity exceeding 22 million gallons. A June 2021 release of UAN from a leaking underground line contaminated groundwater beneath the property; subsequent monitoring documented nitrate and nitrite-nitrogen concentrations ranging from 353 to 30,400 mg/L, far exceeding both the MTCA Method B cleanup level of 26 mg/L and the federal maximum contaminant level of 10 mg/L. Approximately 21,000 gallons of UAN-impacted groundwater were recovered during interim remediation in late 2021, and the site has entered the Voluntary Cleanup Program with cleanup awaiting further action. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
CF Industries' bulk storage operations at this property date to 1983, placing the facility squarely within the era when occurrence-based Commercial General Liability policies were standard and carried no effective pollution exclusion. The documented groundwater contamination — nitrate concentrations exceeding cleanup standards by orders of magnitude — has already generated significant remediation costs, including interim groundwater recovery and ongoing monitoring, with full cleanup still ahead under the VCP. Historical CGL carriers who covered the facility's operations during that pre-1986 window may bear obligations toward these past and future remediation expenditures.
