Tacoma Rail has operated at this location since 1914, functioning as a working railyard with operations and maintenance buildings for over a century. Creosote-treated wooden crossties, in place for an extended period, are identified as a source of pre-existing PAH contamination at the property. In 2022, a spill from a broken underground pipe triggered the current cleanup investigation; suspected groundwater contaminants include PAHs, metals, PCBs, arsenic, lead, and mercury, with groundwater at just 30 inches below the surface and the full nature and extent of contamination not yet defined. Cleanup is underway under Ecology's Standard Cleanup program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

Railyard operations at this property date to 1914 — more than seven decades before 1986, when occurrence-based CGL policies were standard and carried no effective pollution exclusion. Creosote-treated crossties, identified as a source of PAH contamination at the site, were in place throughout that pre-1986 operational window. With cleanup now underway and suspected groundwater contamination spanning multiple contaminant classes, the investigation and remediation costs attributable to pre-1986 releases may fall within the coverage obligations of historical carriers whose policies were in force during those decades of railyard use.
