This site sits on the BNSF Railway mainline (Seattle Subdivision) in Clark County, a rail corridor in continuous operation since the 19th century under BNSF and its predecessor railroads, including Burlington Northern and Northern Pacific. In April 2021, a locomotive at milepost 130 experienced a mechanical failure that released oil at the property. Seven contaminant classes — including PAHs, lead, benzene, petroleum-diesel, and other petroleum products — are now suspected in groundwater, and the SHARP assessment noted potential impacts to nearby Whipple Creek and proximity to Lake River. The site is classified under the Standard Cleanup program and awaits remediation. Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

BNSF and its predecessor railroads have operated this mainline corridor since the 1800s, a history confirmed by the 1977 USGS topographic quadrangle depicting the rail line at this location. That decades-long pre-1986 operational presence means occurrence-based Commercial General Liability policies were issued to railroad operators during an era when those policies carried no effective pollution exclusion. With seven contaminant classes suspected in groundwater and cleanup costs yet to be incurred, historical carriers from the pre-1986 operational window may be obligated to fund the remediation ahead.
