The Amazon Mine, part of the United Copper Group near Chewelah, was acquired in 1891 and saw active production across two periods — 1906 to 1931 and 1955 to 1959 — yielding 10.5 million pounds of copper, 1.7 million ounces of silver, and 1,400 ounces of gold. An original mill was constructed on site in 1913, and in 1932 the Chewelah Copper Company reopened the UC#2 tunnel and acquired leases on the Amazon and neighboring mines. Water emanating from mine openings now carries metals into surface water, with discharge from the UC#2 adit flowing into a collection pond at the headwaters of Nance Spring; metals priority pollutants are suspected in groundwater. The site is classified as Awaiting Cleanup under Washington's Standard Cleanup program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
Copper, silver, and gold mining at this site began nearly a century before 1986, with operations dating to 1891 and production running through 1959. The metal contamination now discharging from mine openings into surface water at the headwaters of Nance Spring is a direct legacy of those decades of extraction. Investigation, remediation design, and cleanup costs the property now faces could plausibly be funded by historical carriers whose occurrence-based CGL policies were in effect during the mine's operational life, before effective pollution exclusions became standard.
