Clover Park Technical College was established in 1942 as a wartime vocational training school and has operated continuously at its Lakewood campus since that time. Tetrachloroethylene (PCE), a halogenated solvent historically associated with industrial and vocational training operations, was detected beneath Building 22 — a structure old enough to require demolition in 2018 and replacement by Building 24. The site lies within the wellhead protection zone of four municipal water supply wells, and halogenated solvent contamination in groundwater is suspected but has not yet been confirmed through sampling. Cleanup is underway under Washington's Standard Cleanup program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
The college's vocational and industrial training operations date to 1942, placing more than four decades of campus activity squarely within the era when occurrence-based Commercial General Liability policies were issued without effective pollution exclusions. PCE found beneath aging campus infrastructure points to releases tied to those pre-1986 operations, and the site's proximity to four wellhead protection wells raises the prospect of significant investigation and remediation costs still to come. Historical CGL carriers who covered the college during that operational window may be obligated to fund both the ongoing cleanup and the remediation expenditures ahead.
