The facility continued under various ownerships through 2017, with petroleum releases documented over its operational history, including gasoline releases in 2010 and 2013 and a renewable diesel spill in March 2017. Diesel fuel reached groundwater and threatened the Columbia River, prompting installation of recovery wells to intercept contaminated groundwater and prevent further migration. Cleanup is ongoing under the Standard Cleanup program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington.
