This property has a documented history as a industrial and manufacturing facility predating 1986. Historical insurance policies issued during operations at this property and through 1986 could fund a cleanup — and recover costs already spent.

The BNSF Fallbridge Subdivision is a mainline railroad corridor along the Columbia River in Benton County, operated by BNSF Railway and its predecessor railroads — including Burlington Northern and Northern Pacific — since the 1800s. In September 2014, a locomotive struck a rock at milepost 202.5, puncturing the fuel tank of locomotive #9488 and releasing diesel fuel into the surrounding environment. Groundwater monitoring confirmed diesel-range organics (DRO) at 630 µg/L in monitoring well AMW-1, exceeding the MTCA Method A cleanup level of 500 µg/L, with subsequent quarterly sampling showing declining but detectable concentrations. Cleanup is underway under the Standard Cleanup program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
