This property has served as an auto repair facility since at least 1912, when Sanborn Fire Insurance Maps first documented an auto repair and painting garage on the site. The current building was constructed in 1927, and city directory listings confirm a continuous succession of automotive businesses — including Burns John Garage, Acme Garage, Lee Art Auto Services, Ruda's Welding & Mach, and German Auto Parts and Repair — spanning from the 1930s through the 1980s. The site is enrolled in the Voluntary Cleanup Program with halogenated solvents identified as contaminants of concern; a 2015 Phase I Environmental Site Assessment documented the property's extensive operational history, and cleanup work is underway. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
Auto repair and painting operations at this site date back more than seven decades before 1986, the year occurrence-based Commercial General Liability policies ceased to be the industry standard. Halogenated solvents — chemicals commonly associated with automotive degreasing and parts cleaning — have been identified as contaminants of concern at the property, consistent with the type of gradual releases that occur over decades of continuous shop operations. CGL policies issued to the successive operators of this facility during its pre-1986 history may be obligated to cover both the remediation costs already incurred and the cleanup work still ahead.
