Astro Auto Wrecking is a family-owned auto salvage facility in Federal Way that has been in operation since 1985, with the property also historically associated with salvage operations under the names Leo's Auto Wrecking and Secoma Salvage & Towing. Ecology's Site Hazard Assessment identified contamination in groundwater and surface water, including lead, polycyclic aromatic hydrocarbons (PAHs), benzene, petroleum hydrocarbons, and other metals — with stormwater grab samples confirming diesel-range organics at 3.4–7.8 mg/L and oil-range organics at 1.6–4.5 mg/L in surface runoff discharging to East Hylebos Creek, exceeding Method A groundwater cleanup levels. Multiple ERTS complaints have documented petroleum discharge to Hylebos Creek. The site is listed under the Standard Cleanup program and is currently awaiting cleanup. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
Auto salvage operations at this property began in 1985, within the era when occurrence-based Commercial General Liability policies were the industry standard and carried no effective pollution exclusion. The contamination now documented across groundwater and surface water — petroleum hydrocarbons, lead, PAHs, benzene — is consistent with decades of vehicle dismantling and fluid handling at the facility. The investigation, remediation, and surface-water restoration costs the property now faces could plausibly be funded by historical carriers whose CGL policies were in effect during those pre-1986 operations.
