The Port of Vancouver is a public port district established in 1912, with rail infrastructure at this location in continuous use for over a century. In January 2014, a BNSF locomotive diesel spill was discovered at the site, resulting in soil contamination measured at 39,000 ppm diesel — well above MTCA Method A cleanup levels — with residual contamination remaining beneath rail infrastructure. Groundwater is suspected to be affected by petroleum-diesel compounds, and a 2024 SHARP report scored the groundwater pathway at C3, noting the site lies approximately 1,500 feet from the Columbia River. Cleanup is underway through the Standard Cleanup program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
The Port of Vancouver has operated continuously since 1912, placing more than seven decades of its history within the pre-1986 era when occurrence-based Commercial General Liability policies were the industry standard. Those policies, issued without an effective pollution exclusion, remain potentially responsive to environmental liabilities arising at the facility. With diesel contamination exceeding state cleanup standards and residual contamination trapped under active rail infrastructure, the remediation costs at this site — already in progress — represent the kind of expenditures that historical CGL carriers may be obligated to fund.
