This property sits on the former Wildcat Lake, which the City of Spokane filled with garbage, ash, and debris in a 1907 municipal project. The surrounding area was subdivided and developed in the late 1800s and early 1900s, and a gas station — Kar Brite — later operated on the site, with underground storage tanks removed in 2010. Site characterization has confirmed contamination from the historical fill material, including elevated heavy metals and polycyclic aromatic hydrocarbons (PAHs) in soil and groundwater. Cleanup is underway under the Voluntary Cleanup Program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington.
