Whatcom County Central Shops is a 147-acre public works vehicle maintenance facility in Bellingham with underground storage tanks that have been in service long enough for the county to have planned their replacement since at least 2008 due to age. A 5,000-gallon waste oil UST was decommissioned and closed in place in December 1999 after years of use, and a diesel cleanup project was underway by 2006. A 2008 groundwater investigation attributed gasoline-range organics and benzene contamination to historic fueling activities at the site, and as of February 2023, monitoring wells showed benzene concentrations as high as 2,000 µg/L — 400 times the state cleanup standard — with contaminated groundwater flowing toward Silver Creek and Bellingham Bay. Cleanup is ongoing under the Standard Cleanup program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
The county's fueling infrastructure at this facility — including original USTs that remain unreplaced after decades of service — dates to well before 1986, and the 2008 groundwater investigation explicitly tied the benzene and petroleum contamination to those historic fueling operations. CGL policies issued to the county during those early decades of fueling carried no effective pollution exclusion under Washington law, making them potential sources of recovery for the substantial remediation costs this site continues to generate. With benzene levels still hundreds of times above cleanup standards and sensitive fish-bearing habitat downgradient, the remaining cleanup obligations represent exactly the kind of long-tail environmental liability those historical policies were written to cover.
