This property was first developed as a convenience store and gas station in 1985, with three 12,000-gallon gasoline underground storage tanks installed that same year. Remediation under the Voluntary Cleanup Program included excavation and removal of 90 tons of petroleum-impacted soil in 1992, installation and sampling of six groundwater monitoring wells, and groundwater sampling in 1993 and 1994 during UST and piping upgrade activities. The site received a No Further Action opinion from Ecology in April 2017. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
The gasoline USTs at this property were installed in 1985 — the final year before occurrence-based Commercial General Liability policies were replaced industrywide with claims-made forms carrying absolute pollution exclusions. Benzene and petroleum hydrocarbons released from those tanks triggered documented cleanup expenditures spanning soil excavation, groundwater monitoring, and tank system upgrades over more than two decades. CGL policies in force during 1985 operations may still carry obligations to indemnify the property owner for those remediation costs.
