This industrial property operated as a lumber mill from the mid-1950s through the early 1990s, with pentachlorophenol dip tanks in use from approximately 1973 to 1983. Pentachlorophenol has been confirmed in groundwater at elevated concentrations near the former dip tank area, and dioxins and furans have been detected in Bear Creek sediment and on-site drainage ditches. Oregon DEQ issued a Record of Decision in September 2007 and approved a Remedial Action Plan for the South Parcel in July 2023, with remedial action — including excavation, consolidation, activated carbon amendment, capping, and wetland restoration — planned for summer 2025, while the North Parcel still requires construction of a permanent engineered cap. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Oregon — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
The contamination at this property originated from pentachlorophenol dip tank operations that ran from 1973 to 1983, entirely before 1986, at a lumber mill that had been operating since the mid-1950s. The remediation work ahead — excavation, consolidation, activated carbon amendment, and capping of the South Parcel, construction of the North Parcel's permanent engineered cap, wetland restoration, and ongoing monitoring and reporting under Oregon DEQ oversight — represents costs that pre-1986 carriers may be obligated to fund going forward.
