This former service station and heating oil supply property — operated over the years by Vemor Corporation, Moran Oil Company, and A-1 Oil — released gasoline from underground storage tanks into soil and groundwater. Oregon DEQ has an active Cost Recovery Agreement in place since February 2024 and an assigned project manager overseeing the case. A revised subsurface investigation work plan was submitted in June 2024 and fieldwork was performed in July 2025, but the investigation report has not yet been submitted to DEQ, and no remediation work has begun. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Oregon — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
The gasoline contamination at this property originated from service station and heating oil supply operations that predate 1986. With subsurface fieldwork completed but the investigation report not yet submitted to Oregon DEQ and no remediation work begun, the investigation, remediation, and long-term monitoring costs this property still faces represent a substantial obligation that historical carriers for the site's operators may be obligated to fund.
