Preliminary Site-Specific Analysis

This property has a documented history as a public works and maintenance facility predating 1986. Historical insurance policies issued during those prior operations and through 1986 could help fund the ongoing and future cleanup under Oregon DEQ oversight.

This 246-acre county-owned property served as the Columbia County Fairgrounds, where waste oils were applied to a racetrack for dust control — producing polycyclic aromatic hydrocarbon (PAH) contamination in soil — and industrial waste including railroad ties, paint cans, and metal-bearing pellets were disposed on site. Nitrate and ammonia concentrations in groundwater have exceeded maximum contaminant levels for more than 25 years, with contamination confirmed across multiple media including soil, groundwater, and pond and stream sediments. Oregon DEQ approved a Remedial Action Plan in March 2002, but it was never implemented; Knife River Corporation entered the Voluntary Cleanup Program in June 2024 and is now conducting groundwater evaluation with monitoring well installation and sampling under active DEQ oversight. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Oregon — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

The PAH contamination from waste oil application and the decades of groundwater nitrate and ammonia exceedances at this property trace to operations that were well established before 1986. With a Remedial Action Plan approved in 2002 but never implemented and active groundwater evaluation now underway through Oregon DEQ's Voluntary Cleanup Program, the investigation, remediation, and long-term monitoring work ahead represents a substantial ongoing obligation that historical pre-1986 carriers may be required to fund going forward.
