This industrial property along the Willamette River hosted continuous heavy industrial operations from 1905 through the late 1970s, including lumber milling, woolen manufacturing, marine ironworks, and plywood production. When the buildings were razed in the late 1970s, an estimated 500–600 tons of sandblasting waste from marine tank cleaning were placed as fill along the riverbank, introducing PCBs, dioxins and furans, PAHs, pesticides, and metals into soil and sediment. Oregon DEQ executed a Consent Order in March 2021 directing the responsible parties to design and construct an engineered riverbank source control measure; the 60% Design Report was completed in June 2025, with the 90% design anticipated in early 2026 and removal of contaminated riverbank soils expected to begin in late summer 2026. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Oregon — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
The contamination at this property originated from continuous industrial operations — including lumber milling, woolen manufacturing, marine ironworks, and plywood production — that spanned from 1905 through the late 1970s, entirely before 1986. The engineered riverbank construction, contaminated soil removal, groundwater pathway evaluation, and long-term monitoring directed by Oregon DEQ's Consent Order represent substantial ongoing and future cost obligations that historical pre-1986 carriers may be obligated to fund going forward.
