This property has a documented history as an industrial and manufacturing facility going back to 1947. Historical insurance policies issued during those prior operations and through 1986 could help fund the ongoing and future cleanup under Oregon DEQ oversight.

This approximately 140-acre industrial property operated as a lumber mill from 1947 to 1994, with Ewauna Box Company occupying the southern portion even earlier. Decades of wood product manufacturing left multi-media contamination — petroleum from hydraulic machine leaks and underground storage tanks, pentachlorophenol from a wood treating dip trench, and PAHs, PCBs, metals, and dioxins in soil, groundwater, and Lake Ewauna sediments. While individual lots received No Further Action determinations between 2003 and 2005, two Prospective Purchaser Agreement Consent Judgments entered in 2017 and 2019 remain active, and Oregon DEQ continues to oversee the site under assigned project status with Contaminated Media Management Plans, deed restrictions, and sediment remediation at Lake Ewauna still ahead. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Oregon — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

Contamination at this property originated from lumber mill operations, hydraulic equipment, underground storage tanks, and wood treating activities that began as early as the 1940s and ran for over four decades before 1986. The substantial work ahead under two active Consent Judgments — including sediment investigation and remediation at Lake Ewauna, ongoing CMMP compliance, and management of residual soil and groundwater contamination — represents future cleanup costs that pre-1986 CGL carriers may be obligated to fund going forward.
