Underground mining at this property began in 1926 as the Silver Butte Mine, with sulfide mineral extraction (pyrite, chalcopyrite, sphalerite) continuing until 1937 and resuming briefly from 1990 to 1993 under Formosa Exploration Inc. Acid rock drainage from the network of underground mine workings has been discharging to Middle Creek and South Fork Middle Creek since the drainage control system failed in 1997, with extensive contamination confirmed in surface water, groundwater, and stream sediment. The site was listed on the EPA National Priorities List in 2007, and while a Record of Decision for Operable Unit 1 was issued in 2016, the Operable Unit 2 Remedial Investigation was only finalized in October 2025 — meaning remedy selection and full remediation for the site's water and sediment contamination remain ahead. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.
