This industrial property transitioned from commercial to full industrial use between the late 1950s and the 1970s, accumulating extensive chlorinated solvent and petroleum contamination — including PCE, TCE, cis-1,2-DCE, benzene, and methylene chloride — confirmed in groundwater, soil vapor, and indoor air. A 1991 underground storage tank decommissioning revealed the scope of contamination, and Oregon DEQ has maintained active oversight since, with a Consent Order (OPVC-NWR-17-02) directing ongoing remediation. An SVE system is currently operating, vapor intrusion controls are installed in on-site buildings, quarterly groundwater monitoring continues through Q4 2025, and 1,4-dioxane was identified in groundwater in 2023 and recently added to the remediation scope. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Oregon — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
The contamination at this property originated from industrial operations that began in the late 1950s and expanded through the 1970s, well before 1986. Under Oregon DEQ's active Consent Order, the work ahead — including continued SVE operation, vapor intrusion controls, quarterly groundwater monitoring, and the newly scoped 1,4-dioxane remediation — represents substantial costs that historical pre-1986 carriers may be obligated to fund going forward.
Restorical's role is to locate viable historical policies, determine whether a successful coverage claim is possible, and assist our clients and their legal counsel to obtain insurance coverage.
