No remediation has been completed, no No Further Action determination has been issued, and the site remains on Oregon DEQ's Confirmed Release List as an unassigned project. A July 2025 DEQ narrative update identifies Ballweber Industries as a potential PFAS source, signaling renewed investigative interest and the prospect of expanded site characterization. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Oregon — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
The chlorinated solvent contamination at this property — first identified in a public water supply well in 1990 and investigated by Oregon DEQ through 1996 — is consistent with industrial operations conducted before 1986. With no remediation completed and a 2025 Oregon DEQ narrative update now signaling renewed investigative interest and expanded PFAS concerns, the investigation, delineation, and remediation costs this property still faces are the type of future obligations that historical CGL carriers may be obligated to fund.
