This 660-acre industrial property operated as a sawmill and powerhouse from 1929 to 1992, with an on-site burn landfill dating to 1929. Decades of operations left extensive multi-media contamination — chlorinated solvents (TCE, PCE, vinyl chloride) and free product in groundwater, oily sheen discharging to the Klamath River, and river sediments contaminated with arsenic, chromium, copper, mercury, and PAHs at levels toxic to benthic organisms. Weyerhaeuser entered Oregon DEQ's Voluntary Cleanup Program in 2000, but a conditional No Further Action determination proposed in December 2013 was never finalized, a recommended risk assessment was never completed, and two solvent-contaminated source areas were never remediated. The site remains an Assigned cleanup project under active DEQ oversight as of May 2026. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Oregon — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
The contamination at this property traces to sawmill, powerhouse, and burn-landfill operations that ran continuously from 1929 through 1992 — more than five decades of activity before 1986. The unfinished risk assessment, unremediated solvent source areas, and ongoing groundwater and sediment investigation directed by Oregon DEQ represent substantial future cleanup costs that historical pre-1986 carriers may be obligated to fund going forward.
Restorical's role is to locate viable historical policies, determine whether a successful coverage claim is possible, and assist our clients and their legal counsel to obtain insurance coverage. Restorical then manages the claim, including accounting, to ensure the cleanup is funded in a timely manner.
