This property has a documented history as a landfill going back to 1958. Historical insurance policies issued during those prior operations and through 1986 could help fund the cleanup that lies ahead.

This property served as the disposal site for mill tailings from uranium mining and milling operations that ran from the late 1950s through 1960 at the nearby Lakeview Mill Plant, with contaminated material excavated and relocated here between 1986 and 1989. Radium, thorium, and uranium are present in the disposed tailings, and groundwater beneath the site shows elevated manganese and sulfate concentrations well above background levels — prompting Oregon Water Resources Department to enact water well restrictions in 2004. Long-term groundwater monitoring continues under the U.S. Department of Energy's UMTRA program, and Oregon DEQ has identified further investigation of arsenic contamination as still required, with recent remediation work plans filed in 2022 and 2023. Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Oregon — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

The radioactive and chemical contamination at this property traces to uranium mining and milling operations conducted from the late 1950s through 1960 — well before 1986 — with the resulting mill tailings excavated and relocated to this disposal site between 1986 and 1989.
