This former plywood mill was built by the end of 1951 and operated continuously until its closure in 1975, with a fire destroying the mill structure in 1976. Operations involved phenol-formaldehyde resin use, wigwam burner operations, and petroleum storage, with documented glue waste spills and piping leaks during active production. A 2018 Phase II Environmental Site Assessment confirmed groundwater contamination at multiple locations — gasoline and diesel concentrations far exceeding screening levels near the wigwam burner area, pentachlorophenol (PCP) at more than fifty times its screening level, and formaldehyde detected in seven of eight groundwater samples above residential tap water thresholds. Dioxin and furan testing in January 2019 found concentrations up to 244 pg/g TEQ at the wigwam burner area, and four geophysical anomalies indicating possible buried underground storage tanks have yet to be excavated — no cleanup has ever been performed at this site. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Oregon — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
