This former municipal landfill operated as a dump-and-burn facility for the City of Eugene from 1938 through the early 1950s and was reopened in 1977 for land-clearing debris disposal. An EPA site inspection in 1980 discovered corroding drums containing heavy metals, and a 1984 Preliminary Assessment confirmed contamination at the property. Reconnaissance groundwater sampling in 2018 revealed arsenic at roughly 650 times the screening-level risk-based concentration, along with significant exceedances for lead, diesel-range organics, and residual-range organics in shallow perched groundwater. The current owner has enrolled in Oregon DEQ's Independent Cleanup Pathway, and a 2022 Focused Site Investigation recommends surface waste removal, cap supplementation, and development of a Soil Cap Operations and Maintenance Plan — none of which has yet begun. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Oregon — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
