This 80-acre property in Lane County encompasses the former Bethel-Danebo Landfill, which accepted construction, demolition, and municipal solid waste from 1970 to 1977, and the former Lane Plywood mill, which left thick layers of buried wood waste in the subsurface. Methane gas migrating from the decomposing landfill and wood waste poses an explosive risk to buildings at the Pioneer Business Park now occupying the site, and groundwater contamination has prompted deed restrictions prohibiting on-site groundwater use across the majority of the property's lots. Oregon DEQ confirmed in May 2025 that no site-wide remedy is in place — partial No Further Action determinations issued for specific lots addressed only soil and groundwater, explicitly excluding methane — and a 2010 federal Consent Decree requires Lane County to conduct ongoing landfill gas monitoring and methane-reduction efforts. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Oregon — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
The contamination at this property originated from landfill operations that accepted waste from 1970 to 1977 and industrial wood-waste disposal during the same era, well before 1986. With no site-wide methane remedy yet in place despite more than fifteen years under a federal Consent Decree, the ongoing landfill gas monitoring, methane-reduction efforts, and remediation work still ahead for this property represent substantial costs that historical pre-1986 carriers may be required to fund going forward.
