This industrial property has been in continuous use since the early 1940s, beginning with WWII-era shipbuilding, followed by steel pipe and tanker truck manufacturing from 1950, and Northwest Pipe Company operations from 1982 — with Phase I/II assessments in 1988–1989 revealing petroleum hydrocarbons, chlorinated solvents, PCBs, and PAHs in soil, along with groundwater contamination from a leaking underground storage tank. Volatile organic compounds in the shallow aquifer continue to exceed Portland Harbor Record of Decision cleanup levels, and the site has been identified as a potential source of contamination to the Portland Harbor Superfund site and Willamette River sediments. Oregon DEQ has maintained active oversight under a Letter Agreement since 1988, with monitored natural attenuation of groundwater ongoing since 2016, dioxin and furan stormwater monitoring continuing, and no site-wide No Further Action determination issued. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Oregon — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
The contamination at this property — chlorinated solvents, petroleum hydrocarbons, PCBs, and PAHs — traces to industrial operations spanning from the early 1940s through the decades that followed, well before 1986. The ongoing groundwater monitoring, plume management, dioxin and furan assessment, and source control measures directed by Oregon DEQ and EPA represent substantial current and future costs that pre-1986 carriers may be obligated to fund going forward.
