The Massoud Property in Lynnwood sits immediately south of Sparky's Towing and Auto Recycling, and a complaint filed with the Snohomish Health District in July 1997 identified contaminated soil on the property bearing the chemical signature of vehicle towing, dismantling, and petroleum operations at the adjacent facility. A cleanup response in March 1998 included removal of contaminated soil and placement of clean fill. Site hazard assessment and scoring continued through at least 2000, and the property remains in Awaiting Cleanup status under Ecology's Standard Cleanup program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
The contaminant profile here — petroleum hydrocarbons, lead, cadmium, and PCBs — is characteristic of vehicle dismantling and petroleum operations that predate the 1986 shift away from occurrence-based Commercial General Liability coverage. Leaded gasoline, reflected in the co-occurrence of TPH and lead at the site, was phased out before 1986, placing the likely origin of this contamination within the window when CGL policies carried no effective pollution exclusion. The remediation expenditures already incurred — contaminated soil removal, clean fill placement, and multi-year site hazard assessment — may be recoverable from the historical carriers whose policies were active when these contaminants were first deposited.
