This property operated as the Ferndale Grain Inc. facility, a bulk feed mill and mash plant with vertical bulk storage tanks and a commercial truck scale. Two underground storage tanks — one gasoline, one diesel — were installed in 1984 to serve the facility's operations. Both USTs were closed in place in 1991 by pumping out residual fuel and filling them with approved material. Limited groundwater removal occurred in 1994 during monitoring well sampling, and further groundwater pumping and treatment were recommended if contamination levels persisted; the site remains in awaiting-cleanup status under the Standard Cleanup program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
Petroleum contamination at this site originated from underground storage tanks installed in 1984 — two years before occurrence-based Commercial General Liability policies gave way to claims-made forms with absolute pollution exclusions. The presence of leaded gasoline in the tank history further anchors the contamination to the pre-1986 policy era. With the site still awaiting full cleanup, the investigation, design, and remediation costs the property owner faces could plausibly be funded by historical carriers whose CGL policies were in force when these tanks were actively dispensing fuel.
