This property has served as a gasoline station since the 1950s, with a newer facility constructed in 1961 and auto repair operations conducted on-site until the 1980s. Underground storage tanks were replaced in 1987 and pump islands were replaced in 1994. Cleanup activities reported in 1994 included excavation and on-site bioremediation of 400 cubic yards of petroleum-contaminated soil, potential removal of a waste-oil tank, and operation of a groundwater treatment system utilizing a ten-foot deep trench with sump pumps, an aerator, and a carbon filter. Cleanup work is ongoing. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
Petroleum contamination at this site originated from underground storage tanks and fueling operations that began in the 1950s — more than three decades before occurrence-based CGL policies gave way to claims-made forms with absolute pollution exclusions. The pre-1987 USTs and detection of lead in groundwater samples point to decades of leaded-gasoline dispensing under policies that contained no effective pollution exclusion in Washington.
