This property served as a bulk fuel farm at Seattle-Tacoma International Airport, with underground storage tanks for jet fuel, gasoline, kerosene, diesel, and fuel oil installed as early as the late 1940s — some of which were removed as far back as 1965. Cleanup under the Standard Cleanup program has included removal of a 10,000-gallon underground storage tank and 125 cubic yards of petroleum-impacted soil, operation of a soil vapor extraction system from 1992 to 1996, and multi-year groundwater monitoring with passive product recovery continuing from 1993 through 2000. A cleanup action plan for soil and groundwater has been prepared, and remediation work is ongoing. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
Petroleum contamination at this site originated from bulk fuel storage and distribution infrastructure that was installed before 1950 and operated continuously through the decades when occurrence-based Commercial General Liability policies carried no effective pollution exclusion in Washington. The documented remediation expenditures — tank removal, soil excavation, vapor extraction, and years of groundwater monitoring and product recovery — are tied directly to historical operational releases from that pre-1986 fuel farm. Historical carriers who issued CGL policies to the operators during that window may be obligated both to recover costs already incurred and to fund the cleanup work that remains ahead.
Restorical's role is to locate viable historical policies, determine whether a successful coverage claim is possible, and assist our clients and their legal counsel to obtain insurance coverage. Restorical then manages the claim, including accounting, to ensure the cleanup is funded in a timely manner.
