This property formerly operated as Jim's U-Save Gas Station, with underground storage tanks dispensing gasoline at what is now the Brown Bear Car Wash site on Rainier Ave S in Renton. Cleanup under the Voluntary Cleanup Program has included UST and piping removal, excavation of 490 cubic yards of petroleum-contaminated soil, recovery of 1,000 gallons of contaminated groundwater, and active remediation through air sparging, soil vapor extraction, dual phase extraction, and hydrogen peroxide injection. Post-remedial groundwater monitoring ran from July 2011 through June 2012, and cleanup work remains ongoing. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
Gasoline contamination at this site originated from underground storage tanks associated with a former gas station operation predating 1986, when occurrence-based Commercial General Liability policies were the industry standard and carried no effective pollution exclusion. The documented remediation expenditures — tank removals, soil excavation, groundwater recovery, and years of active treatment and monitoring — represent both costs already incurred and obligations that continue to accrue as cleanup proceeds. Historical carriers who issued CGL policies during the gas station's pre-1986 operational window may be obligated to recover past cleanup costs and fund the remediation still ahead.
