This property has operated as a gasoline service station since 1971, when Time Oil Co. purchased the site and installed underground storage tanks for leaded and unleaded gasoline. Petroleum contamination was discovered during a UST upgrade in October 1994, prompting excavation and removal of 30 cubic yards of impacted soil and 1,600 gallons of contaminated groundwater. Subsequent remediation has included pilot tests for groundwater pumping, soil vapor extraction, and air sparging, as well as enhanced bioremediation using oxygen-releasing compound installations and ongoing multi-year groundwater monitoring that has documented natural attenuation and biodegradation. The site continues to operate as a Shell-branded service station with a mini-mart and two pump islands. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington.
