The Washington Mine operated as a lead, zinc, silver, and iron mine in Metaline Falls from at least 1924 through 1943, with the last known active operation in 1936. The site is now inactive, with a large, open, flooded adit at the base of Washington Rock adjacent to the Pend Oreille River. An Abandoned Mine Lands Initial Investigation has been completed, identifying environmental hazards and recommending further sampling and analysis; no cleanup or remediation work has commenced. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington.
