Petroleum contamination at this site stems from underground storage tanks and industrial operations that were in place decades before 1986, when occurrence-based Commercial General Liability policies were the standard and carried no effective pollution exclusion. The remediation expenditures already incurred — tank removals, soil excavation, contaminated-soil disposal — and the costs of ongoing investigation and future monitoring represent obligations that historical carriers who issued CGL policies during the plant's pre-1986 operational window may be required both to recover and to fund going forward.
