Preliminary Site-Specific Analysis

This property has a documented history as a gasoline service station going back to 1976. Historical insurance policies issued during operations at this property and through 1986 could recover the cleanup costs already paid.

This property has operated as a retail petroleum facility since approximately 1976, with underground storage tanks dispensing regular leaded, regular unleaded, and super unleaded gasoline. Remediation under the Voluntary Cleanup Program included the removal and replacement of a UST, recovery of 100 gallons of gasoline product, and off-site thermal treatment of nearly 199 tons of contaminated soil in 1995, along with removal of 200 gallons of contaminated water. A further UST system upgrade in 2014 required additional excavation of contaminated soil. Residual contamination remains contained beneath asphalt and concrete under an Environmental Covenant established in 2005, with required long-term groundwater monitoring, cap maintenance, and periodic five-year reviews. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

Petroleum contamination at this site originated from underground storage tanks installed and operated continuously since 1976 — a decade before occurrence-based Commercial General Liability policies gave way to claims-made forms with pollution exclusions. The documented remediation expenditures spanning from 1995 through at least 2014, plus ongoing monitoring and cap-maintenance obligations, represent costs tied directly to releases from those pre-1986 operations. Historical carriers who issued CGL policies covering this facility during its first decade of operation may still be obligated to reimburse those cleanup costs.

Restorical's role is to locate viable historical policies, determine whether a successful cost recovery claim is possible, and assist our clients and their legal counsel to obtain insurance coverage for costs already incurred. Restorical's forensic accounting team works to re-establish and document past cleanup expenditures, ensuring the strongest possible basis for recovery.

Recovering Costs from an Older Cleanup

If this site reached No Further Action years ago, the original cleanup expenditures may be difficult to reconstruct. Restorical's forensic accounting team specializes in re-establishing and documenting past cleanup costs — even decades later — to build the strongest possible basis for an insurance recovery claim.

The Restorical Proven Process

Task 1 — Research and Analysis
Restorical searches for viable historical insurance policies, researches the site history, analyzes the contamination impacts, and underwrites potential coverage — including a proprietary trigger analysis. At the end of Task 1, we provide a clear yes or no on whether a successful cost recovery is possible, along with a strategy and recommendation specific to your situation, even if you are not the policyholder.
Task 2 — Cost Recovery
When Task 1 confirms viable coverage, Restorical works with your legal counsel to tender the claim and negotiate recovery of costs already incurred. Restorical's forensic accounting team re-establishes and documents past cleanup expenditures, managing the claim process to ensure the insurance companies fulfill their obligation in a timely manner.
